1. Acceptance of Terms

By accessing or using any Javek product, platform, or service — including Jav3, Javek data analysis pipelines, or any associated APIs — you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must immediately discontinue use of all Javek services.

These terms apply to all users, clients, partners, and any individual or entity accessing Javek systems, whether through a direct agreement, a free trial, or an authorized third-party distribution channel.

2. Use of Services

Javek grants you a limited, non-exclusive, non-transferable, revocable license to access and use our services strictly in accordance with these Terms. You agree not to:

• Use Javek services for any unlawful, harmful, or fraudulent purpose
• Reverse engineer, decompile, or attempt to extract source code from any Javek software
• Use Jav3 or any autonomous agent to access systems or data without proper authorization
• Resell, sublicense, or redistribute Javek services without prior written consent
• Introduce malware, bots, or scripts that interfere with platform integrity
• Circumvent access controls, rate limits, or security measures

Javek reserves the right to modify, suspend, or discontinue any service at any time without notice. We are not liable for any modification, suspension, or discontinuation of services.

3. Intellectual Property

All content, code, models, algorithms, trademarks, logos, and materials associated with Javek — including Jav3 and all related software — are the exclusive intellectual property of Javek and its licensors. No ownership rights are transferred to you through your use of our services.

Any outputs generated by Javek systems on your behalf belong to you, subject to the condition that you may not claim intellectual property rights over the underlying models or algorithms that produced them.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Javek shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of, or inability to use, any Javek service.

Javek's total cumulative liability to you for all claims arising under these Terms shall not exceed the greater of (a) the amount you paid to Javek in the twelve months preceding the claim, or (b) one hundred US dollars ($100).

5. Data & AI Outputs

You are solely responsible for the accuracy, legality, and appropriateness of any data you input into Javek systems. Javek does not guarantee the accuracy or completeness of AI-generated outputs. All outputs should be reviewed by qualified professionals before being used to make material decisions.

Autonomous agent actions carried out by Jav3 are performed at your direction and under your authorization. Javek is not liable for consequences arising from autonomous actions taken on your behalf.

6. Termination

Javek may terminate or suspend your access to all or part of our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the services will immediately cease.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

1. Data We Collect

Javek collects data necessary to operate, improve, and secure our services. This includes:

• Account information: name, email address, organization, and billing details provided at registration
• Usage data: interactions with the platform, feature usage frequency, session durations, and error logs
• Input data: files, datasets, queries, and instructions you submit to Javek or Jav3
• Device and technical data: IP address, browser type, operating system, and device identifiers
• Communication data: messages you send to our support or sales team

We do not knowingly collect personal data from individuals under 18 years of age.

2. How We Use Your Data

Javek uses collected data to:

• Deliver, maintain, and improve our products and services
• Authenticate users and prevent unauthorized access
• Generate AI outputs and autonomous agent actions you request
• Send service-related communications, updates, and security alerts
• Comply with legal obligations and resolve disputes
• Conduct anonymized research to improve AI model performance

We do not sell your personal data to third parties. We do not use your input data to train our models without explicit, separate written consent.

3. Data Sharing

We may share your data only in the following limited circumstances:

• With vetted infrastructure partners (cloud hosting, analytics) operating under strict data processing agreements
• With law enforcement or regulatory authorities when required by applicable law
• In connection with a merger, acquisition, or sale of all or substantially all of our assets
• With your explicit consent for a specific purpose you have authorized

4. Data Retention

We retain your personal data for as long as your account is active or as needed to provide services. Input data processed by Jav3 or our analysis pipelines is retained for a maximum of 90 days unless you request earlier deletion or a longer retention period is required by law.

5. Your Rights

Depending on your jurisdiction, you may have rights including:

• The right to access the personal data we hold about you
• The right to correct inaccurate or incomplete data
• The right to request deletion of your personal data
• The right to restrict or object to certain processing activities
• The right to data portability in a structured, machine-readable format

6. Cookies

Javek uses cookies and similar tracking technologies to maintain session state, analyze usage patterns, and improve performance. You can control cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of our platform.

We implement industry-standard technical and organizational measures to protect your data, including AES-256 encryption at rest, TLS 1.3 in transit, role-based access controls, and continuous security monitoring. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

Javek builds autonomous AI systems with safety as a foundational constraint, not an afterthought. We believe that AI capable of independent action carries significant responsibility. Our systems are designed to be powerful and trustworthy — and we hold ourselves and our users accountable for how that power is applied.

Our core safety principles are: transparency in how our systems operate, controllability so humans can always intervene, minimal footprint so autonomous agents only take necessary actions, and non-deception so our AI never obscures what it is doing or why.

2. Human Oversight

All Javek autonomous systems, including Jav3, are designed to support human oversight at every stage. This means:

• All significant autonomous actions are logged and made reviewable by the authorizing user
• Users can pause, stop, or roll back autonomous processes at any time
• High-impact actions — such as sending communications, modifying critical files, or accessing external services — require explicit user confirmation unless pre-authorized
• No autonomous agent can modify its own operational permissions or safety constraints

3. Prohibited Uses

Javek systems may not be used for any of the following purposes:

• Unauthorized access to systems, databases, networks, or accounts owned by others
• Surveillance, tracking, or profiling of individuals without their knowledge and consent
• Generation or distribution of disinformation, deepfakes, or deceptive content
• Circumventing legal or regulatory requirements in any jurisdiction
• Any activity that constitutes harassment, discrimination, or targeted harm against individuals or groups
• Development of weapons systems or technology intended to cause physical harm
• Automated decision-making about individuals in high-stakes domains (employment, credit, healthcare) without appropriate human review and legal compliance

Violations of these prohibitions will result in immediate account termination and may be referred to relevant authorities.

4. Jav3 Desktop Agent Safety

Because Jav3 operates directly on your desktop and can take real-world actions on your behalf, we have implemented specific safeguards:

• Sandboxed by default: Jav3 operates within user-defined permission boundaries and cannot self-escalate privileges
• Action confirmation: Irreversible actions (file deletion, form submissions, external communications) trigger a confirmation step by default
• Full audit trail: Every action taken by Jav3 is recorded with timestamps, context, and the instruction that triggered it
• Emergency stop: A dedicated keyboard shortcut immediately halts all Jav3 activity
• Scope limitation: You can restrict Jav3 to specific applications, folders, or domains — preventing it from acting outside defined boundaries

5. Bias & Fairness

We recognize that AI systems can reflect and amplify biases present in training data or design decisions. Javek is committed to:

• Ongoing evaluation of our systems for bias across demographic groups, use cases, and data domains
• Publishing transparency reports on model behavior and known limitations
• Providing users with tools to identify and flag potentially biased outputs
• Engaging with independent auditors to assess our systems on a regular basis

We do not consider our bias mitigation work complete. It is an ongoing commitment that will evolve alongside our technology.

6. Reporting Safety Concerns

If you encounter behavior from any Javek system that appears unsafe, harmful, unexpected, or in violation of these guidelines, please report it immediately to [email protected].

We take all safety reports seriously. You will receive an acknowledgment within 24 hours and a detailed response within 7 business days. Reports submitted in good faith will never result in account penalties. We welcome responsible disclosure from security researchers under our coordinated disclosure program.
